These Terms of Use (“Terms”) govern your access to and use of the services, platforms, applications, software, APIs, websites, and other offerings (collectively, the “Services”) provided by Kenshi Ltd (“Kenshi,” “we,” “our,” “us”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
1. Definitions
- “User,” “you,” or “your” refers to any individual or entity accessing or using the Services.
- “Services” means all products and platforms provided by Kenshi, including but not limited to the Kenshi Anti-Cheat solution and Ronin AI DevSecOps platform.
- “Content” means all materials, software, data, reports, documentation, trademarks, logos, and other assets made available through the Services.
- “Agreement” refers collectively to these Terms, the Privacy Policy, and any other legal notices or agreements applicable to your use of the Services.
2. Eligibility & Account Use
- You must be 18 years or older (or the age of majority in your jurisdiction) to use the Services.
- If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
- You agree to provide accurate, current, and complete information when registering or interacting with the Services.
3. Scope of Services
Kenshi provides:
- Enterprise-Grade Anti-Cheat Protection powered by Ronin AI, including DMA detection, memory monitoring, behavioral analysis, overlay detection, exploit prevention, and kernel integrity checks.
- Ronin AI DevSecOps Platform, an intelligent control layer unifying infrastructure deployment, compliance, monitoring, and automated remediation.
Kenshi may update, enhance, or modify the Services at its sole discretion. Certain features may require subscription, licensing, or separate agreements.
4. Acceptable Use
You agree not to:
- Use the Services for unlawful purposes, including the creation, promotion, or distribution of cheats, exploits, or malicious tools.
- Reverse engineer, decompile, disassemble, or attempt to derive source code from the Services.
- Circumvent, disable, or tamper with any security features or restrictions of the Services.
- Interfere with or disrupt the operation of the Services or related networks.
- Access the Services in a manner intended to avoid fees or misuse resources.
- Use the Services to transmit harmful code, malware, or conduct fraudulent activities.
Violation of this section may result in immediate suspension or termination of your account and potential legal action.
5. Intellectual Property Rights
- All rights, title, and interest in and to the Services, including but not limited to software, algorithms, interfaces, and detection technologies, are and shall remain the exclusive property of Kenshi Ltd or its licensors.
- You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services strictly in accordance with these Terms.
- Kenshi trademarks, logos, and branding may not be used without prior written consent.
6. Privacy & Data Security
- Kenshi implements privacy by design and complies with applicable data protection laws.
- By using the Services, you consent to the collection, storage, and use of your data as described in our Privacy Policy.
- You acknowledge that Kenshi may collect telemetry, system integrity data, and behavioral information solely for security, compliance, and service improvement purposes.
7. Service Levels & Availability
- Kenshi strives to maintain high availability, performance, and security, but does not guarantee uninterrupted Services.
- Scheduled maintenance, upgrades, or unforeseen outages may limit availability. Kenshi shall not be liable for downtime.
- Kenshi may modify or discontinue features at any time without liability, provided such changes do not materially degrade core functionality without notice.
8. Fees & Payment
- Access to certain Services may require subscription or licensing fees.
- Fees are billed according to the pricing agreed upon at purchase or contract.
- All payments are non-refundable unless required by applicable law.
- You are responsible for all taxes, duties, or levies arising from use of the Services.
9. Warranties & Disclaimers
- The Services are provided on an “AS IS” and “AS AVAILABLE” basis.
- Kenshi disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
- Kenshi does not guarantee that the Services will:
- Detect or prevent all cheating, malicious activity, or system intrusions.
- Be error-free, secure, or continuously available.
10. Limitation of Liability
To the maximum extent permitted by law:
- Kenshi shall not be liable for indirect, incidental, punitive, or consequential damages.
- Kenshi’s total aggregate liability for all claims shall not exceed the amount paid by you to Kenshi in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Kenshi, its directors, employees, and affiliates from and against any claims, damages, liabilities, or expenses (including legal fees) arising out of:
- Your misuse of the Services.
- Violation of these Terms.
- Infringement of any third-party rights.
12. Termination
Kenshi may suspend or terminate your access if:
- You breach these Terms.
- Your use poses a risk to security, performance, or integrity.
- Required by law or regulatory authority.
Upon termination, all licenses granted under these Terms shall immediately cease.
13. Compliance with Laws
You are responsible for ensuring your use of the Services complies with all applicable laws, including but not limited to export controls, sanctions, and data protection regulations.
14. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of London, UK.
15. Changes to Terms
Kenshi reserves the right to update these Terms at any time. Updates will be posted with a revised effective date. Continued use of the Services constitutes acceptance of the changes.
